(a) NO PREEMPTION OF STATE LAWS REGARDING ABORTION.—Nothing in this Act shall be construed to preempt or otherwise have any effect on State laws regarding the prohibition of (or requirement of) coverage, funding, or procedural requirements on abortions, including parental notification or consent for the performance of an abortion on a minor. ‘‘(d) EXISTING PROGRAMS OF HEALTH PROMOTION OR DISEASE PREVENTION.—Nothing in this section shall preempt any State law related to programs of health promotion offered by a health insurance issuer that offers health insurance coverage in the individual market in such State that was established or adopted by State law on or after the date of enactment of this Act." PART III—ENCOURAGING DEVELOPMENT OF NEW PATIENT CARE MODELS
SEC. 3021. ESTABLISHMENT OF CENTER FOR MEDICARE AND MEDICAID INNOVATION WITHIN CMS.
(a) IN GENERAL.—Title XI of the Social Security Act is amended by inserting after section 1115 the following new section: ‘‘CENTER FOR MEDICARE AND MEDICAID INNOVATION
‘‘SEC. 1115A. (a) CENTER FOR MEDICARE AND MEDICAID INNOVATION ESTABLISHED.—
‘‘(1) IN GENERAL.—There is created within the Centers for Medicare & Medicaid Services a Center for Medicare and Medicaid Innovation (in this section referred to as the ‘CMI’) to carry out the duties described in this section. The purpose of the CMI is to test innovative payment and service delivery models to reduce program expenditures under the applicable titles while preserving or enhancing the quality of care furnished to individuals under such titles. In selecting such models, the Secretary shall give preference to models that also improve the coordination, quality, and efficiency of health care services furnished to applicable individuals defined in paragraph (4)(A).
‘‘(2) DEADLINE.—The Secretary shall ensure that the CMI is carrying out the duties described in this section by not later than January 1, 2011.
‘‘(3) CONSULTATION.—In carrying out the duties under this section, the CMI shall consult representatives of relevant Federal agencies, and clinical and analytical experts with expertise in medicine and health care management. The CMI shall use open door forums or other mechanisms to seek input from interested parties.

‘‘(B) OPPORTUNITIES.—


b. Co-pay or multiple flexible costs to service obligations

‘‘(3) BUDGET NEUTRALITY.—‘‘(A) INITIAL PERIOD.—The Secretary shall not require, as a condition for testing a model under paragraph (1), that the design of such model ensure that such model is budget neutral initially with respect to expenditures under the applicable title.
‘‘(B) TERMINATION OR MODIFICATION.— The Secretary shall terminate or modify the design and implementation of a model unless the Secretary determines (and the Chief Actuary of the Centers for Medicare & Medicaid Services, with respect to program spending under the applicable title, certifies), after testing has begun, that the model is expected to—
‘‘(i) improve the quality of care (as determined by the Administrator of the Centers for Medicare & Medicaid Services) without increasing spending under the applicable title;
‘‘(ii) reduce spending under the applicable title without reducing the quality of care; or
‘‘(iii) improve the quality of care and reduce spending. Such termination may occur at any time after such testing has begun and before completion of the testing. (Page 743-744)

(c) BUDGET-NEUTRALITY ADJUSTMENT.—Section 1848(c) (2) (B) of the Social Security Act (42 U.S.C. 1395w–4(c)(2)(B)) is amended by adding at the end the following new clause: (Page 811)


SEC. 3142. APPLICATION OF BUDGET NEUTRALITY ON A NATIONAL BASIS IN THE CALCULATION OF THE MEDICARE HOSPITAL WAGE INDEX FLOOR FOR EACH ALL-URBAN AND RURAL STATE.
In the case of discharges occurring on or after October 1, 2010, for purposes of applying section 4410 of the Balanced Budget Act of 1997 (42 U.S.C. 1395ww note) and paragraph (h)(4) of section 412.64 of title 42, Code of Federal Regulations, the Secretary of Health and Human Services shall administer subsection (b) of such section 4410 and paragraph (e) of such section 412.64 in the same manner as the Secretary administered such subsection (b) and paragraph (e) for discharges occurring during fiscal year 2008 (through a uniform, national adjustment to the area wage index). c. Generic vs. Brand Name products and regulation

‘‘(c) EXPANSION OF MODELS (PHASE II).—Taking into account the evaluation under subsection (b)(4), the Secretary may, through rulemaking, expand (including implementation on a nationwide basis) the duration and the scope of a model that is being tested under subsection (b) or a demonstration project under section 1866C, to the extent determined appropriate by the Secretary, if—
‘‘(1) the Secretary determines that such expansion is expected to—
‘‘(A) reduce spending under applicable title without reducing the quality of care; or
‘‘(B) improve the quality of care and reduce spending; and
‘‘(2) The Chief Actuary of the Centers for Medicare & Medicaid Services certifies that such expansion would reduce net program spending under applicable titles. (Page 955)

SUMMARY OF THE BAUCUS HEALTH CARE BILL OF 2009

Summary: There is more rhetoric in this bill and the reallocation and future allocation of medical care or one sixth of the US GDP than any other bill in history. Words such as “budget neutrality” actually suggest “bias” and names such as “Secretary” refer to the President or an assigned dictator of the problem. When it comes to abortion and illegal aliens; words are used like a caricature to imply rhetoric and state rights; although the funding is from the US Federal Government; the implementation suggest State’s allocation. Then the breaking point is the terms used “expansion of program” and “budget neutrality.” There is no way a company or business can run on this type of language. Also, it will not be long until someone ends up in court to clarify the rhetorical budgeting of this which places no caps or cost ceilings. On specific issues such as illegal aliens or non citizens it is left to the State laws. On other very controversial parts such as abortion; it also demands clarification on the State level. This is total lunacy and insanity put into law and verbal mental poetry. Explicitly it is some form of communism, socialism, or a practical prank to anger the logical acumen and mental capacity of those who read it and tried to understand it. This is a classic example of mind control. This form of mind control is so large; it will fuel huge bureaucrats and yield tremendous political dangers already known and identifiable.

Fiscal budgets merely hints to the “budget neutrality” and finalization of the bill based on spending until each person is equally cared for based on equal amounts of reallocation based on State laws. This is hard to determine as people move or are reallocated by either jobs or opportunity; then retirement based on a lifestyle budgeted decades ago. Had this been a computer program and the code for an operating system it would receive an F or D grade; it could not compile or even be read; no less algorithms or real formulas which inputs and outputs can be transferred and used in a finite and real number. If you send a value to a State; it must be constrained by both limits and ceilings; if not then a definitive number. The bill it absolutely nonsense and makes no sense whatsoever; this is why none of it can be explained; but the debate is “it is something, which is better than nothing.” Someone can read this and declare it witchcraft or some form of black magic where property values and real estate ownership is inflated and used to mesmerize the living dead and the criminal element in a conspiracy. The power of suggestion is you will be taken care of and the government is a new altered state of consciousness where someone will have to explain this in real numbers and real language. The work should be crumpled up and burned as a heating element on a cold night. It might have a stronger and more valuable worth rolled up and used as a blunt instrument to clobber someone with.

‘‘(g) REPORT TO 1 CONGRESS.—Beginning in 2012, and not less than once every other year thereafter, the Secretary shall submit to Congress a report on activities under this section. Each such report shall describe the models tested under subsection (b), including the number of individuals described in subsection (a)(4)(A)(i) and of individuals described in subsection (a)(4)(A)(ii) participating in such models and payments made under applicable titles for services on behalf of such individuals, any models chosen for expansion under subsection (c), and the results from evaluations under subsection (b)(4). In addition, each such report shall provide such recommendations as the Secretary determines are appropriate for legislative action to facilitate the development and expansion of successful payment models.’’.
(b) MEDICAID CONFORMING AMENDMENT.—Section 1902(a) of the Social Security Act (42 U.S.C. 1396a (a)), as amended by sections 5103 and 5105, is amended— (1) in paragraph (77), by striking ‘‘and’’ at the end; (Page 748)

• There are 600 miles of road from east to west through Kabul. ALL roads going EAST will be shut down and guard post placed before going into Kabul and all capital cities.
• Roads destroyed by bombing must be repaired and rebuilt; bring in paving and new roads with TOLL booths but use ID and clan passport systems to expedite guard posts.
• One road will be open; only one. One road north and one east; only one. All others will have guard posts. All roads going west will have a guard post and check point east; OPEN UP THE SOUTHERN REGION AND WESTERN REGION.

Brief notes on the Taliban:
• Trying to unite the country and using corruption and anti-business rhetoric to tax farmers and free enterprise; to cut off the Mujahadeen and the warlords; they are similar to the Democrats or liberals. The Taliban are the little guys. They do not respect the sovereignty of others and are taxing; jealousy drives them to ban and nit pick.
• The rule of thumb is to respect the rights of others or else have yours taken; you do not blame or point the finger and say it is corruption; yet no formal law beside the use of Sharia is offered in place of this anti-corruption campaign. We get this all the time and it ends up very taxing.
• The Taliban has also used foreign ties to undermine or deny the rights of other clans or tribal leaders; yet the incoherence of the bully tactics is what we see all the time and is hidden by wars or some spread of strategic strong arm power grab. To label their power struggle as anti-corruption is rhetoric of the left wing. This is a very taxing army to independent and tribal clans. The Northern Alliance respected each other enough to fight together to kick out an invader; this is an enemy within trying to eradicate or kick out the loose associations of warlords. In other words it is a nationalist group and they do not respect the sovereignty of regions.
• 1994 they are trying to nationalize the schools and industry; to be a power and bully in southern Afghanistan. We tend to associate this with modernization or Maoism. The strategic platform of corruption is very methodical and a pattern of behavior; therefore, the Taliban is an insurgent group and also a nationalist movement. We call this the labor unions or labor leaders on attack. Once in power, they become the thought police and ban books or knowledge in order to indoctrinate and brainwash the next generation and drive the current one into fear or hiding.
• The timing of the Taliban is odd, 1994. This is right on time when this threat came on the national scene and began tricking everyone into thinking they were a positive force; they are Zionists or linked to the little guy plot; I had been taking classes with a class full of Arab women at the time and the Red Dragon was watching and hit their home provinces. They were amazing and models; all very westernized and engaged; what we call “marriage and family types.” There was a strange element and I remember their spy; a very pretty union-emissary; named Ms. Miner who wore see through shirts. So they were friendly, Ms. Miner was not and a nationalist and union spy.
• It is a catholic and Zionist based spy or power grab; happiness is what they combat. You cannot enjoy things and are kidnapped while they demand unity and production from you; very taxing. I was being watched at the time in 1993 to 1995 while doing my Arab and religious studies.
• America and the west are viewed as weak on crime; therefore, they use that to gain power. I can see right through it; it is the little guys who say and do anything; the Red Dragon and the left wing. They did the same thing to me, ban happiness and joy while imposing some extortion plot. All the people I was with at the time were very western and laid back; even the Pakistani martial arts teacher. Someone was watching and then they attacked. They saw we got along great and tried to break it or dominate it; the usual divide and conqueror. It is the little guys and the same people who waged war on America.
• We judged them backwards but they are actually backwards; and they are getting even for Vietnam and killing Zionists in war. It is revenge killing for war on the little guys and the left wing communists. They are the bosses of all minorities and races; they are superior even if the little guys; a very taxing menace and plague. They clone who is superior; sleeper spies. The hatred is towards Iran, this ethnic Hazara, and Shia religious sovereignty.
• They must have been stalking me and targeting my classmates and allies. It appears that the former communist forces merged with the ionists and used the little guys’ financial systems to compel their pride and humus; to view others as an enemy of the state and attack them or kill them off. They were making an offer and brought heads of classmates or decent people for this recruitment. STAGE 1: A PRIMER TO AFGHANISTAN BASED ON EXPERIENCE IN IRAQ; OCT 11, 2009

After seeing what I saw and knowing what I know; I would not sign up for another Iraq in the next 30 years. It is this vaccine and turning off the harassment, the protection racket, we keep seeing; that needs to be annihilated. Here is the briefing of what is going on.
• The first part of running a perfect war is preparation. The more the troop level, the more the deterrence and show of force. The longer you wait, the more threat posed and lives lost while in suspended animation. Obviously, Iraq was not the best ran war and driven to ruin by a scandal ridden administration. We will recheck and redo this the right way and in the most cost efficient and yearly periods. Our estimation is no more than two years.
• I have never seen anybody take the Gulf War to Iraq and spent 5 billion a month while using up 7 years to win a war. To me, this is unconscionable and I am not a conscientious objector. Our objective in Afghanistan is to only prevent Pakistan from falling and they are close to it. WE HAVE A SABOTEUR AND SPY ON US AT THIS TIME AND THEY ARE BLOCKING; REMOVE OR KILL THEM; ARM THE PALESTINIANS AS A DETERRENCE AND TO ANGER THE FOR A RETALIATION. STAY OUT OF OUR LIFE AND OUR FUTURE OR FACE DIRE CONSEQUENCES; DO NOT EVER COME BACK AND OVERTHROW THE USA. IF THEY DO NOT HEED THE WARNINGS; WE WILL HAVE NO CHOICE BUT TO ESCALATE.
• All foreign countries are a threat unless validated and accredited; Israel and clandestine voices for Israel is banned from the debate until or unless we receive full parity of this little guy plot (World War II extortion effort.)
• The time line for Afghanistan is yearly. I have no idea who is running these wars, if it is to loot the treasury, if some brain dead enemy has taken over and subordinating the military and ruining our image and political careers. However, Iraq should have taken not more than 3 years. The objective is simple 1) Prevent Pakistan from falling 2) after one year, to leave the Taliban in a condition where they cannot invade or tip the scale in Pakistan.
• The more the better; so even if it takes only 10,000 troops; bring 40 to 60,000 if you can or if it is available. This speeds things up and ensures no goofs have any voice.
• Unlike Iraq, you do the air war first and turn on or off grids; not drive around as sitting ducks; obviously, something is very wrong here. Who chose a ground war over an air war? Then who steered the attention from Afghanistan to Fallujah by lynching my SEAL buddy Scott? Who blew up the Marine barracks again for this air base in Israel?
• The strategy or battle plans are never disclosed prior to battle but if someone must know; a grid will be developed and I will pose questions to the Generals; I will not answer the question, they will and they will see it also; I will asked them to light up one grid or the other; then to turn off a grid and they will see what I am doing. Actual battle never begins; it takes up to 3 to 6 months before actual battle begins.
• I am no novice at this and like upstairs and the people who targeted the Vietnam Vets, screwed their minds up, caused tremendous grief and pain when veterans come back from war (Vietnam) we caught them in the act and we know it is the left wing, communist, Mussad, Israel, and the liberals targeting veterans. They view us as lab rats and guinea pigs; their experiment; to create a negative effect because after wars veterans parade and celebrate; they take that away and make life hell. This is what they did after Vietnam; they do this to everybody they can in the military and we caught them. I will turn them over to the Generals with extreme prejudice and ask them what they wish to do or how they want to finish these spies and Viet Cong sappers off. Understand, they are continuing the war on their buddies and who is their brothers in arms.

• There is a heavy emphasis with air power in Afghanistan. I do not want to hear Iran or sticking it with Afghanistan. I keep hearing it as if we are stupid and need some vaccine to turn off harassment or some terror plot.
• If this terror plot is not complete and apprehended by a time line; we will recommend clandestine activity against those responsible; this means arming the enemies and disrupting and usurping their governments; allies or not. Tell your Mussad upstairs to buy explosives or make a phone call on their cell if they wish to check for surveillance; not drive around looking safe and bold.
